Saturday, December 21, 2024 – Note: KSFG DBA Unlawful Detainer Lawsuits have declined significantly since 2017. This could be attributed to changes that have taken place within the KSFG companies. Abraham Arrigotti, past President, departed Sierra Corporate Management in Jul 2016 after 17 years with KSFG companies. It was also reported to the MHPHOA that the KSFG/Hart King (Eviction Attorneys) business relationship may have been severed in late 2017.

Here are 746 resident names, a small percentage of “human lives”, NOT chattel, that have been the victims of Kort & Scott Financial Group (KSFG) DBAs and Sierra Corporate Management (SCM) eviction proceedings in the California Civil Courts.

We’ve coined a new phrase for the process these individuals have endured for years, we call it being “Evictimized”, and refer to the human lives as “Evictims”, the victims of being victimized, and evicted from their mobile homes that many paid for in full – they rightfully owned their homes.

Most of the names on the list are the ex-mobile homeowners. Some are family members of the ex-homeowner, their siblings, their loved ones, roommates, anyone who SCM had the homeowner list on the lease or rental agreement. For some, it was the son who listed his disabled mother and grandmother. For others, it was the sister who listed the two other sisters who needed a place to stay because they were down on their luck.

Many of these ex-mobile homeowners just walked away and never appeared in Civil Court – they thought that was the best option and it would be the end of it. Unfortunately, there are “default judgments” being issued by the court clerk regularly to KSFG DBAs.

These default judgments normally include the possession of the mobile home and in addition, there are monetary damages being awarded to the KSFG DBAs in the range of $4,000 to $9,999 or more. We’re certain that a large percentage of these residents who just walked away do not know that they have court ordered financial judgments against them.

We have spreadsheets with the monetary judgments against the residents. The KSFG DBAs have been awarded millions of dollars in damages from these ex-mobile homeowners.

These unexposed predatory business practices have been at play for over two decades and there may be thousands of victims to locate. This financial devastation has occurred at untold levels in the States of Arizona, California, Colorado, Florida, Illinois and New Mexico.

We are also certain that many of these victims do not know that they have a negative mark on their credit report for seven (7) years. Not only that, the KSFG DBAs are in court regularly collecting on the monetary judgments which may entail the garnishment of up to 25% of take home pay and/or a levy against any personal property of value e.g. vehicles, motorcycles, tools.

As of Saturday, December 21, 2024, there are 746 resident names listed below. This is a sampling from sixteen (16) of the thirty-nine (39) mobile home parks in California currently or previously owned by a Kort & Scott Financial Group DBA and managed by Sierra Corporate Management.

We will update this list regularly as the resident names become available. Last names have been masked, first and middle names have been initialized. The date to the right of the name (for the majority) is when the Writ of Possession was wholly satisfied by the local Deputy/Sheriff. This means the mobile home owner and all named occupants have been successfully evicted. For some individuals, this date represents a judgment date where a financial loss was involved e.g. a collection judgment.

Lincoln Center Mobile Home Park

In October 2015, a 1994 Fleetwood mobile home occupying space [000] in Lincoln Center Mobile Home Park (Owned by a KSFG Company) sold for $21,000. According to online documents, the new homeowner(s) signed the standard twenty-one (21) page, twenty-five (25) year long-term lease.

In April 2016, five (5) months later, an Unlawful Detainer (UD) lawsuit was filed against the new homeowners (Defendants) by Lincoln Center GP LLC (Plaintiffs) by Kevin Scott, authorized representative for Lincoln Center Mobile Home Park. The residents were late with their rent one time and served with a combined 3/60 notice (Pay Rent or Quit).

In August 2016, Lincoln Center GP LLC, represented by Hart King Attorneys at Law, won a Stipulated Judgment against the two (2) homeowners listed in the Unlawful Detainer (UD). That judgment appears to entail the surrender of the mobile home in exchange for no claims ($0) against the homeowners. A Writ of Possession (lockout) date of October 11, 2016 was agreed to by all parties.

Define: Moral Turpitude

A phrase used in Criminal Law to describe conduct that is considered contrary to community standards of justice, honesty, or good morals. Turpitude means a corrupt, depraved, degenerate act or practice that shocks the public conscience.

California Business and Professions Code §6106, §6107

• 6106. The commission of any act involving moral turpitude, dishonesty or corruption, whether the act is committed in the course of his relations as an attorney or otherwise, and whether the act is a felony or misdemeanor or not, constitutes a cause for disbarment or suspension.

  If the act constitutes a felony or misdemeanor, conviction thereof in a criminal proceeding is not a condition precedent to disbarment or suspension from practice therefor.
